An Italian man has filed a lawsuit against a restaurant, claiming that a video posted on social media without his consent led to the revelation of his infidelity and the breakup of his marriage.
An unusual legal dispute has begun in Italy. A 42-year-old man from Sicily accuses a local establishment of causing his divorce by posting a TikTok ad.
The restaurant posted a short video to promote its services, unaware that the recording featured a customer who was not accompanied by his wife. The man didn't give permission to be filmed, but he can be clearly seen in the footage at a table with another woman. The video quickly gained views and eventually reached his wife directly or through acquaintances who recognized him in the recording.
It later emerged that the man had claimed to be at a work meeting that evening. The TikTok video became irrefutable proof of his infidelity. As a result, she decided to end the relationship and kicked him out of the house.
Following this, the Italian man filed a lawsuit, alleging a gross violation of his privacy. His position was supported by the consumer protection association Codacons, which took on his representation. The organization emphasizes that filming clients without consent and using such footage for advertising purposes is contrary to current legislation.
Lawyers Warn of Risks
Codacons representative Francesco Tanasi noted that such publications can have serious and unpredictable consequences, affecting reputations, family life, and personal relationships. The association is seeking compensation for moral damages and is not ruling out an appeal to the national data protection authority.
Lawyers believe this case could serve as a shining example for businesses and marketers actively working on social media, and serve as a reminder of the fine line between effective advertising and invasion of privacy.
