In Spain, a non-consensual hand kiss was recognized as sexualized assault
A Spanish court has confirmed that even a seemingly harmless gesture—such as kissing a stranger's hand—can constitute sexualized violence if committed without her consent. The case stemmed from a 2023 incident in Madrid, in which a man kissed a woman's hand at a bus stop and asked her to follow him, promising a monetary reward. The woman perceived the incident as a violation of her privacy and reported it to law enforcement.
The trial court found the man guilty and fined him €1,620, citing the sexual overtones of his actions. This decision was later upheld by a provincial court, which upheld the classification of the incident as a form of sexualized violence.
In his appeal to the Supreme Court, the man insisted that he had not used violence or threatened the woman, arguing that his actions could not have impacted her safety. However, the higher court rejected these arguments, finding that the man's behavior violated personal space and was overtly sexual in nature.
