Not long ago, a high-ranking official was arrested in China and imprisoned for 3 years for destroying a “military marriage.” Moreover, for such an act he was deprived of all state awards and fined a huge amount of money. A few weeks later, another similar news appeared in the People's Court Daily that a businessman surnamed Ma was sentenced to 10 months in prison by a Dunhuang court for the crime of breaking up a military marriage. Of course, a huge fine won’t ruin a millionaire’s life like an official, but it will seriously damage his image and health.
But what does the phrase “military marriage” actually mean? And why does any man face severe punishment for its destruction in China?
What is the destruction of a military marriage in terms of the law in China?
In 2022, businessman Ma met a woman surnamed Yuan who came to work for his company, and that same evening they entered into a sexual relationship.
When Yuan admitted to the businessman that she was married to a PLA (People's Liberation Army) soldier and he could face criminal charges, Ma did not attach any importance to this and assured the woman that everything would be fine.
Soon the woman moved into the private house of businessman Ma, and he began telling all his friends and family that he had found a girl whom he planned to marry.
When Yuan's husband returned home from the army on leave, he noticed that there were no signs of life in their apartment for a long time, the refrigerator was empty, and the tables were covered with a layer of dust. That is, his wife did not live in their apartment for several weeks, and maybe months.
When the husband contacted his wife, she told him that she went on a trip with a friend and lived with her for some time.
A month later, Yuan went to see her husband in the army to ask him to sign official divorce papers. This began to make him think that his wife was not faithful to him.
Returning home, the husband immediately checked all the nearby surveillance cameras in their residential area, and to his surprise, he witnessed his wife’s infidelity (when the businessman drove her to the house and even sometimes stayed in their apartment).
The soldier did not hesitate for long, but called the police and gave them all the evidence he found.

But since Mr. Ma did not deny, but admitted to committing the crime, this meant that at the trial he was given a more lenient sentence. 10 months in prison, and a less serious fine than what he might have expected.
An editorial in the People's Court Daily said Chinese soldiers usually live far from home and are unable to care for their families. Therefore, it is “immoral and criminal” to use their wives to destroy their marriage.
“The destruction of military marriages directly affects the thinking of soldiers and weakens the combat effectiveness of the army. Any activity leading to the dissolution of a military marriage will be severely punished,” the official court statement said.
The punishment for attempting to have a relationship with a military wife is so severe because under China's National Defense Law, the state is required to not only provide special protection for a soldier's marriage, but also respect and protect the honor of military personnel.
Therefore, any marriage of soldiers is referred to as “military,” that is, under the control and protection of the army and the state.
It does not matter that the culprit of such an affair could be the soldier’s wife herself. Only the person who threatened to destroy the soldier’s marriage and prevented his psychological state from being ready to defend his homeland is subject to punishment.
“Chinese criminal law stipulates that anyone who attempts to enter into a romantic relationship with the spouse of a PLA soldier faces up to three years in prison and the loss of all government decorations (if the crime was committed by an official).”
Protection for military marriages ends only after the soldier ends his service.
